Terms of Service

These Terms of Service ("these Terms") set forth the conditions of use for the service "Creepy Hub" ("the Service") provided by IMC ("the Company"). By using the Service, users are deemed to have agreed to these Terms.
Article 1 (Scope)
These Terms apply to all relationships between the Company and users regarding the provision and use of the Service.
Guidelines, policies, individual terms, and other provisions separately established by the Company on the Service or its website ("Individual Provisions") shall constitute a part of these Terms.
In the event of any conflict between these Terms and Individual Provisions, the Individual Provisions shall prevail.
Article 2 (Definitions)
- "User" refers to any individual or entity that browses, uses, posts, or performs any other action on the Service in agreement with these Terms.
- "Posted Content" refers to all information posted, sent, uploaded, or displayed by users through the Service, regardless of format including text, images, videos, audio, links, etc.
- "Intellectual Property Rights" refers to copyrights (including the rights under Articles 27 and 28 of the Copyright Act), patent rights, utility model rights, design rights, trademark rights, and all other intellectual property rights.
Article 3 (Eligibility)
The Service may only be used by persons aged 18 or older.
Users warrant that they meet this requirement when using the Service.
The Company may suspend or delete the account of any user found to be in violation without prior notice.
Article 4 (Service Description)
The Service provides an SNS platform for posting, browsing, rating, interacting, and editing information (including wiki-style features) related to horror content (including fiction, true ghost stories, real-life eerie experiences, movies, dramas, games, and other related works).
Features include posting (text, images, video, audio, etc.), comments, ratings, following, search, reporting, editing, and other functions as determined by the Company.
Posted content meeting certain evaluation criteria may be subject to automatic translation using external services, at the Company's discretion.
The Company does not guarantee the accuracy, completeness, or legality of translations.
The Company may change, add, suspend, or discontinue any aspect of the Service without prior notice to users.
Article 5 (Accounts)
To use the Service, users shall register an account by email registration, linking with external SNS accounts, or other methods approved by the Company.
Users shall maintain accurate and current registration information and shall not register false or inaccurate information.
Users are responsible for managing their account and authentication credentials and shall not allow third parties to use them.
The Company shall not be liable for any damage caused by insufficient account management, user error, or third-party use.
Users may delete their account and withdraw from the Service at any time through the methods provided.
Article 6 (Rights to Posted Content)
Copyright and other intellectual property rights in Posted Content belong to the user who made the post.
Users grant the Company a free, non-exclusive, unrestricted (in territory and duration), sublicensable license to use Posted Content for the following purposes:
- Display, reproduction, public transmission, translation, adaptation, editing, modification, summarizing, excerpting, and all other uses within the Service
- Operation, improvement, promotion, and advertising of the Service
- Use, distribution, and monetization on external services (including YouTube and other platforms) operated by the Company or designated third parties
Such use may include partial omission, editing, mosaic processing, and other modifications of Posted Content.
Users shall not exercise moral rights against the Company or its licensees regarding Posted Content.
This license shall survive deletion of Posted Content by the user and cannot be revoked.
Users warrant that they hold lawful rights to their Posted Content and that it does not infringe on third-party rights.
Article 7 (External Service Use)
The Company may use Posted Content on external services operated by the Company or designated third parties (including but not limited to YouTube, other video distribution services, SNS, and web media) through any method including display, reproduction, public transmission, translation, adaptation, editing, and modification.
Such use may include mosaic processing, subtitle addition, audio processing, structural changes, and other editing.
The Company may monetize such use through advertising revenue and other means.
Users shall have no claims for compensation or remuneration regarding such use.
The Company shall endeavor to provide credit to posters within a reasonable scope but is not obligated to do so.
Article 8 (Automatic Translation)
The Service provides automatic translation functionality using external services designated by the Company.
Translation is applied to Posted Content at the Company's discretion.
The Company does not guarantee the accuracy, completeness, legality, or usefulness of translation results.
Translation results are merely supplementary displays of the original text; the original text shall prevail in interpretation.
Users agree in advance that Posted Content may be sent to external services for translation processing.
Article 9 (Prohibited Actions)
Users shall not engage in any of the following actions when using the Service:
- Actions that violate laws or public order and morals
- Actions that infringe on copyrights, portrait rights, privacy rights, or other rights of third parties
- Defamation, insult, discrimination, or actions causing undue disadvantage to specific individuals or organizations
- Actions that promote or suggest harm, crime, harassment, or other illegal acts against real individuals or organizations
- Unauthorized access, excessive system load, or other actions that interfere with Service operation
- Unauthorized commercial use of the Service
- Other actions the Company reasonably deems inappropriate
Notwithstanding the above, horror content expressions are permitted within the scope of fiction.
However, users shall not post horror content that:
- Depicts real persons or organizations in an aggressive or harmful manner
- Contains discriminatory or hateful expressions based on race, nationality, gender, religion, or other attributes
- Specifically promotes or may incite imitation of real-world illegal or dangerous acts
- Is excessively grotesque or cruel and strongly evokes real physical harm
- Is otherwise deemed inappropriate by the Company in light of the Service's purpose
Article 10 (Deletion/Editing of Posts)
Users may edit or delete their own Posted Content through the methods provided by the Company.
The Company may delete, hide, edit, or take other necessary measures regarding Posted Content without prior notice if it is deemed to violate these Terms or is necessary for Service operation.
Article 11 (Reporting)
Users may report content they believe violates these Terms or applicable laws through the Company's reporting function.
The Company shall review such reports at least weekly but is not obligated to respond within any specific timeframe.
Article 12 (Rights Infringement Claims)
Users or third parties who believe that Posted Content infringes their rights may file a claim through the Company's designated method.
Claims must include at minimum:
- Name and contact information (email, phone number, etc.) of the claimant
- Specific description of the content and rights held
- Identification of the infringing Posted Content (URL, etc.)
- Declaration that the claim is based on legitimate rights
The Company may notify the poster and provide an opportunity for rebuttal within 7 days.

Article 13 (Account Suspension)
The Company may suspend or delete a user's account without prior notice if the user:
- Violates or is likely to violate these Terms
- Engages in defamation, discrimination, or actions causing significant harm to others
- Registers false, inaccurate, or incomplete information
- Uses the Service through unauthorized access or other improper methods
- Has not used the Service for an extended period
- Is otherwise deemed inappropriate by the Company
Article 14 (Service Suspension)
The Company may suspend, interrupt, or terminate the Service without prior notice in the following cases:
- System maintenance, updates, or repairs
- Technical difficulties including system failures, communication issues, or external service disruptions
- Force majeure events such as natural disasters, power outages, accidents, or pandemics
- Business decisions making continued service difficult or inappropriate
Article 15 (Limitation of Liability)
Users are solely responsible for the content, legality, accuracy, and any third-party rights infringement of their Posted Content.
The Company is not obligated to monitor or manage Posted Content and shall not be liable for any damage arising from such content.
The Company shall not be liable for any damage to users related to the Service, except in cases of intentional misconduct or gross negligence.
Article 16 (Exclusion of Anti-Social Forces)
Users represent and warrant that they are not and will not become members of organized crime groups, related enterprises, or similar organizations, and have no relationship with such groups.
Article 17 (Personal Information)
The Company collects users' email addresses, usernames, Posted Content, and other information in connection with providing the Service.
The Company may establish a separate Privacy Policy regarding the handling of personal information, which shall constitute a part of these Terms.
Article 18 (Intellectual Property Rights)
Copyright, trademark rights, and other intellectual property rights related to all components of the Service, including programs, systems, designs, UI, logos, trademarks, displays, and text, belong to the Company or legitimate third-party rights holders.
Users shall not infringe on the Company's or third parties' intellectual property rights beyond the scope of use under these Terms.
Users shall not reproduce, modify, adapt, publicly transmit, redistribute, or otherwise use content included in the Service without the Company's prior written consent.
Article 19 (Amendment of Terms)
The Company may amend these Terms by providing prior notice to users when deemed necessary.
Such notice shall be provided at least one week before the effective date through posting on the Service, the Company's website, or other appropriate methods.
Users who continue to use the Service after the effective date shall be deemed to have consented to the amendments.
Article 20 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan.
Any disputes arising between the Company and users in connection with the Service or these Terms shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the Company's location as the court of first instance.
